The National LGBTQ Task Force Responses to Supreme Court Decisions on Transgender Participation in Sports and Birthright Citizen

The following can be attributed to Allen Morris, Policy Director, National LGBTQ Task Force:

“Today’s decision is devastating and the impact is clear. While this is not a nationwide ban on transgender participation in sports, the Court has given states a legal pathway to attempt to discriminate against trans individuals from full participation in school sports and all aspects of life.  

Behind every legal argument of these cases is a young athlete who simply wanted their humanity to be valued, to belong, be seen, and participate with their peers.  

This decision sets a terrible precedent and opens the door to a larger scope of discrimination against transgender people, and we know is part of a much more organized campaign that goes back to Project 2025 and the exclusion and erasure of transgender people from public life.  

This ruling is not just about sports: it’s about valuing and protecting the safety, security and constitutional rights of transgender people. By allowing states to draw a categorical line based on “biological sex,” the majority has chosen deference to exclusion and political beliefs over transgender students’ lived realities. There is already a dangerous rise in state-based violence growing across the country, and we are overcoming this issue at each turn.  

The reality is that this decision does not implement a nationwide sports ban. States, school districts, and local leaders can make decisions that are inclusive of all. We can make the right choice for all children so they can not only participate in sports but experience the benefits of good health, teamwork, leadership, friendship, and the joy of being cheered on by family and friends. 

We agree with Justice Jackson, who noted that “A transgender woman penalized for being perceived as ‘aggressive’ has experienced discrimination “on the basis of sex” just as much as a cisgender woman has…. 

We understand that this decision is rooted in sexism, misogyny and attempts to stereotype and discriminate against all women.”

“Today’s decision underscores a promise that has never belonged to any one administration, political party, or generation: Citizenship in this country is not a privilege reserved for the powerful, but a constitutional guarantee.  

Days after the country celebrated Juneteenth, today’s ruling matters deeply for marginalized communities. For nearly 90 years, formerly enslaved people were denied citizenship and their humanity. The ratification of the 14th Amendment not only restored what was promised, it also affirmed constitutional protection for every child born to U.S. Citizens.  

Black and brown communities, mixed-status households, and Indigenous communities’ futures should not depend on political uncertainty. We saw what was possible with the decision last week to upend the Temporary Protective Status of hundreds of thousands of Haitians and Syrians. This is why today’s decision is not only a legal victory, but also a moral affirmation that our constitution’s promise is strongest when it protects those most vulnerable from exclusion.  

Our commitment to justice does not end with this ruling. We will always defend the principle that citizenship must not be weaponized to divide families, punish children, push political agendas, or revive the very exclusion the 14th Amendment was designed to abolish.”
