Appeals court sends Prop. 8-related question to California Supreme Court
Today, the Ninth Circuit Court of Appeals asked a question of the California Supreme Court about the standing of the defendants in Perry v. Schwarzenegger. The court stated today that it cannot rule on the constitutionality of Prop. 8 unless both parties have standing, and since neither the governor nor attorney general of California will defend the law, standing remains in question. You can read today’s ruling on the court’s website and more news on the case here.
There is no clear time-line for a response from the California Supreme Court, but we will keep you updated as this case moves forward.
