Appeals court sends Prop. 8-related question to California Supreme Court



Today, the Ninth Circuit Court of Appeals asked a question of the California Supreme Court about the standing of the defendants in Perry v. Schwarzenegger. The court stated today that it cannot rule on the constitutionality of Prop. 8 unless both parties have standing, and since neither the governor nor attorney general of California will defend the law, standing remains in question.
